Welcome to our website WinPrizeClub.com. By accessing or using this Site, including participating in any contests, giveaways, or prize drawings (collectively, “Contests”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to participate.
Contests are open only to legal residents of jurisdictions where such contests are permitted by law.
We reserve the right to verify eligibility and disqualify any participant who does not meet the requirements.

2. No Purchase Necessary

All Contests hosted on this Site are free to enter. However you must be a member of the club to enter contest. Of which there is a month club fee. A purchase or payment of any kind does not increase your chances of winning.

3. How to Enter

Each Contest will include specific entry instructions, deadlines, and rules posted on the Contest page.
By entering, you agree to follow all posted rules and instructions.

4. Winner Selection

Winners are selected at random or by criteria stated in the Contest description.
All decisions regarding winner selection are final.
We reserve the right to disqualify entries that violate these Terms or appear fraudulent.

5. Prize Delivery

Winners will be notified using the contact information provided during entry.
If a winner does not respond within the stated time frame, the prize may be forfeited and awarded to an alternate winner.
Prizes are non‑transferable and may not be substituted unless we choose to offer an alternative of equal or greater value.

6. Taxes & IRS Requirements

Winners are responsible for any federal, state, or local taxes associated with receiving a prize.
If the total value of prizes you receive in a calendar year is $600 or more, we may require you to complete IRS Form W‑9 before awarding the prize.
We may issue a Form 1099‑MISC to you and the IRS as required by law.

7. User Conduct

You agree not to:

Interfere with the operation of the Site
Attempt to manipulate Contest results
Use automated tools, bots, or scripts to enter Contests
Submit false or misleading information

15. Ineligible Participants: Immediate Family & Household Members

To maintain fairness and avoid conflicts of interest, certain individuals are not eligible to join the club or participate in any Contest, giveaway, or prize drawing hosted on this Site.

15.1 Immediate Family Members

The following individuals are strictly prohibited from entering or winning any Contest:

Spouses
Domestic partners
Parents
Children
Siblings
Step‑relations in any of the above categories
Individuals sharing a household with staff, regardless of relationship

15.2 Employees & Affiliates

The following individuals are also ineligible:

Employees, contractors, or representatives of [Your Business Name]
Anyone involved in the administration, development, or execution of the Contests
Business partners, vendors, or service providers directly connected to Contest operations

15.3 Purpose of Restriction

These restrictions exist to ensure:

16. Use of Legal Name for Registration and Prize Delivery

All members must register using their full legal name exactly as it appears on their government‑issued identification. Prizes will only be shipped to the name provided at the time of registration, and winners are required to present valid ID and sign for the package upon delivery. The use of nicknames, initials, aliases, or false identities is strictly prohibited. It is the member’s responsibility to ensure that their registration information is accurate and current. We are not responsible for failed deliveries, returned packages, or forfeited prizes resulting from incorrect, incomplete, or mismatched names provided during registration.

17. Eligibility of U.S. Residents and Prize Delivery Locations

Participation in Contests and eligibility to receive prizes is limited exclusively to individuals who are legal residents of the United States or its official territories. Prizes will only be shipped to valid addresses located within the United States or the following U.S. Territories: Puerto Rico, Guam, U.S. Virgin Islands, American Samoa, and the Northern Mariana Islands. We also ship to United States military bases overseas, including APO, FPO, and DPO addresses, provided they are recognized as U.S. mailing destinations. Prizes will not be delivered to any international or non‑U.S. address outside these approved locations. Any entrant who provides an ineligible address or attempts to claim a prize outside the permitted regions will be disqualified, and the prize will be forfeited.

18. Digital Prize Delivery and Account Security Disclaimer

Digital prizes, including but not limited to gift cards, digital downloads, electronic vouchers, and email‑delivered rewards, will be sent to the email address provided by the member at the time of registration. We are not responsible for any failure to receive digital prizes due to circumstances beyond our control, including but not limited to: hacked or compromised email accounts, phishing scams, spam‑filtering or auto‑deletion, full inboxes, inactive or inaccessible email accounts, viruses or malware on the member’s device, or any unauthorized access to the member’s email or personal devices. Once a digital prize has been sent to the registered email address, it is considered delivered. We assume no liability for lost, stolen, intercepted, deleted, or otherwise unrecoverable digital prizes resulting from user‑side security issues or inaccurate contact information.

19. Prohibition of Bots, Automation, and AI‑Generated Entries

The use of bots, scripts, automation tools, AI agents, macros, or any non‑human method to access the Site, create accounts, interact with features, or submit Contest entries is strictly prohibited. All entries must be submitted manually by a real individual using their own account. Any entry generated, assisted, or influenced by automated technology will be immediately disqualified, and we reserve the right to terminate the associated membership without refund of any membership fees. We may also revoke access to the Site, void prizes, and ban future participation if automated activity is detected or suspected. Our goal is to maintain a fair and authentic experience for all members, and any attempt to manipulate or exploit the system through automation will result in enforcement actions.

20. No In‑Person Prize Pickup & No Guaranteed Shipping Timelines

All prizes will be shipped directly to the winner’s verified mailing address, and in‑person pickup of prizes is strictly prohibited. We do not offer local pickup, office pickup, or hand‑delivery under any circumstances. Additionally, while we make reasonable efforts to process and ship prizes in a timely manner, we do not guarantee any specific shipping date, delivery timeframe, or arrival window. Shipping times may vary due to carrier delays, inventory availability, verification requirements, or other factors beyond our control. By participating, members acknowledge that prize shipment and delivery are not guaranteed within any particular period and that delays do not constitute grounds for refunds, claims, or disputes.

21. Use of Member Photos, Videos, Name, and Likeness

By creating an account or participating in any Contest, members grant us a perpetual, irrevocable, worldwide, royalty‑free license to use their name, photograph, video, likeness, voice, and any submitted content for promotional, advertising, and publicity purposes across our website, social media platforms, marketing materials, and any other media formats now known or later developed. Members also agree that, if they win a prize, we may publicly disclose their name, city, and prize won as part of our winner announcements. This permission is granted without restriction of time, without the need for additional approval, and without any compensation. Members acknowledge that such use is standard practice for transparency and promotional purposes and agree that they have no right to review, approve, or request removal of such materials once published.

22. No Guarantee of Contest Frequency or Prize Value

Members acknowledge and agree that the number of Contests offered, the timing of those Contests, and the availability of prizes are not guaranteed. While we strive to host as many Contests as reasonably possible, we make no promise, commitment, or obligation regarding how often Contests will occur or how many will be available within any period. Additionally, prize values may vary significantly, and there is no set minimum or maximum prize value for any Contest. All prizes are offered at our sole discretion and may differ in type, quantity, and estimated value. Participation in the club does not entitle members to any specific number of Contests or any particular prize value.

23. No Guarantee of Ethical Sourcing or Eco‑Friendly Manufacturing

Prizes offered through our Contests come from various suppliers, retailers, partners, manufacturers, and third‑party sources, and we do not independently investigate or verify the ethical, environmental, or labor practices involved in their production. By participating, members acknowledge that we make no guarantees or representations regarding whether any prize was ethically made, sustainably produced, cruelty‑free, fair‑trade certified, or compliant with any specific environmental or social standards. We rely on the information provided by our suppliers and do not conduct audits or background checks on manufacturing processes. Members agree that we are not responsible for researching, confirming, or ensuring the eco‑friendliness, ethical sourcing, or production conditions of any prize offered.

24. No Liability for Illness, Injury, or Damage Caused by Prizes

By participating in any Contest and accepting any prize, members acknowledge and agree that all prizes—whether physical, digital, consumable, or otherwise—are accepted at their own risk. We make no guarantees regarding the safety, suitability, condition, or intended use of any prize. We are not responsible or liable for any illness, allergic reaction, sickness, injury, bodily harm, death, property damage, data loss, or any other negative outcome that may result from the use, misuse, handling, installation, consumption, or possession of any prize. Members assume full responsibility for evaluating and using any prize safely and appropriately. Once a prize has been delivered, all risk transfers to the recipient, and we disclaim all warranties and liability to the fullest extent permitted by law.

25. No Responsibility for Additional Costs or Fees Associated With Prizes

Members acknowledge that some prizes may require additional fees, subscriptions, services, accessories, upgrades, or modifications in order to function as intended. This may include, but is not limited to, subscription fees, activation fees, paid memberships, installation costs, software licenses, replacement parts, or any expenses needed to alter, assemble, or adapt a prize to meet a member’s personal needs or preferences. We are not responsible for any such costs, nor do we guarantee that any prize will be fully usable without additional purchases. All ongoing or one‑time expenses required to operate, maintain, or enjoy a prize are the sole responsibility of the member. Our obligation ends once the prize is delivered, and we make no promises regarding its long‑term usability, compatibility, or cost of operation.

26. No Obligation to Modify Prizes Based on Personal Beliefs or Preferences

Members acknowledge that some prizes may not align with their personal beliefs, morals, values, or preferences. We are under no obligation to alter, replace, discontinue, or cancel any Contest or prize on the basis that a member finds a prize offensive, inappropriate, or contrary to their individual standards. Participation in each Contest is entirely optional, and members may simply choose not to enter any Contest whose prize they do not wish to receive. Members may also terminate their membership at any time, though no refunds will be issued for any membership fees already paid. By continuing to use the Site, members accept that prize offerings will vary and may not always reflect their personal views or expectations

27. No Responsibility for Service‑Based Prizes, Quality of Service, or Third‑Party Issues

If a prize consists of a service provided by a third‑party business, contractor, or organization, members acknowledge that we are not responsible for arranging, coordinating, scheduling, or managing any aspect of that service. All communication and fulfillment must be handled directly between the member and the service provider. We make no guarantees regarding the quality, professionalism, reliability, safety, or overall standard of the service received, and we are not liable if the service is below expectations, incomplete, delayed, or unsatisfactory in any way. Any disputes, conflicts, cancellations, poor service experiences, or issues that arise between the member and the service provider are solely the responsibility of those parties. We do not mediate disagreements, provide refunds, or offer replacement prizes for problems related to service‑based prizes, and our obligations end once the prize information has been delivered to the winner.

28. Force Majeure

WinPrizeClub shall be excused from performance under these Terms of Use, to the extent it or a Merchant is prevented or delayed from performing, in whole or in part, as a result of an event or series of events caused by or resulting from: (a) weather conditions or other elements of nature or acts of God; (b) acts of war, acts of terrorism, insurrection, riots, civil disorders, or rebellion; (c) quarantines or embargoes; (d) labor strikes; (e) error or disruption to major computer hardware or networks or software failures; or (g) other causes beyond the reasonable control of WinPrizeClub or a Merchant, as applicable.
